1. Agreement to Terms

By accessing or using BiteCal ("the Service"), operated by BiteCal ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Service Description

BiteCal is an AI-powered food calorie counter that analyzes food photos to provide estimated nutritional information including calories, protein, carbohydrates, and fat. The Service uses artificial intelligence and is intended for informational purposes only.

Important: Nutritional estimates provided by BiteCal are approximations generated by AI and should not be considered medically accurate. Do not rely solely on BiteCal for dietary decisions related to medical conditions, allergies, or specific dietary requirements. Always consult a qualified healthcare professional or registered dietitian for medical nutrition advice.

3. Account Registration

To use the Service, you must create an account using Google authentication. You are responsible for maintaining the security of your account and for all activities that occur under your account.

4. Subscription Plans

BiteCal offers the following plans:

  • Free: 3 photo analyses per day
  • Plus ($5/month): 30 photo analyses per day
  • Pro ($12/month): Unlimited photo analyses

Paid subscriptions are billed monthly through our payment processor, Polar. By subscribing, you authorize recurring charges until you cancel. You may cancel your subscription at any time through your account settings or the Polar customer portal.

5. Refund Policy

Refunds are handled in accordance with Polar's refund policies. If you are unsatisfied with the Service, you may request a refund within 7 days of your most recent payment by contacting us at support@bitecal.com. Refund eligibility is determined on a case-by-case basis.

6. Acceptable Use

You agree not to:

  • Upload images that are illegal, harmful, or obscene
  • Attempt to reverse-engineer, decompile, or exploit the Service
  • Use the Service for any unlawful purpose
  • Circumvent usage limits or create multiple accounts to avoid restrictions
  • Use automated systems or bots to access the Service
  • Resell, redistribute, or commercially exploit the Service without written permission

7. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, and software — are owned by BiteCal and protected by intellectual property laws. You retain ownership of food photos you upload, but grant us a limited license to process them for the purpose of providing the Service.

8. AI-Generated Content Disclaimer

Nutritional information provided by BiteCal is generated by artificial intelligence and may contain inaccuracies. We do not guarantee the accuracy, completeness, or reliability of any AI-generated nutritional estimates. Users should verify critical nutritional information through independent sources.

9. Limitation of Liability

To the maximum extent permitted by law, BiteCal shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, but is not limited to, damages arising from reliance on nutritional estimates, dietary decisions, or health outcomes.

Our total liability for any claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that nutritional estimates will be accurate.

11. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms. You may delete your account at any time through the Settings page. Upon termination, your right to use the Service will immediately cease.

12. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by posting the updated Terms on this page with a new "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to conflict of law principles.
